VERSION 2026-10-11

Terma & Syarat Perkhidmatan

Terma bahasa Inggeris yang diluluskan disertakan di bawah. Kontrak sedia ada mengekalkan versi bertarikh yang diterima.

Version 2026-10-11 \| Approved by owner on 11 October 2026. Standard service terms for future accepted orders; not retrospective.
Supplier: OnHypp Digital Resources, operated by Amin Harun (sole proprietor). Business registration: 202203319117 (JR0142601-D). SST registration: P13-2501-32100004. Contact: sales@onhypp.com.
## 1. Agreement and acceptance
These terms apply to the services identified in the accepted quotation, order or invoice. Provide the applicable dated version before acceptance or payment. Acceptance may be recorded by written confirmation or payment after the terms have been supplied. Payment does not remove rights that cannot lawfully be excluded. Material new terms do not retrospectively change an existing paid service term without agreement.
The accepted service-specific quotation or written agreement prevails over these general terms where inconsistent. Retain the accepted version with the invoice. These terms are not effective for a customer merely because an internal draft exists.
## 2. Prices, payment and invoicing
Unless agreed otherwise in writing, new services and renewals require full payment and complete setup information before activation. The invoice states the payment due date, service period, currency, applicable tax and separately priced items. Domain charges included in a package must not be charged again. Payment screenshots are evidence for checking, not confirmation of cleared funds.
OnHypp issues ordinary commercial or service-tax invoices unless a document is actually validated through LHDN MyInvois. A validated e-Invoice will carry the applicable validation particulars. Ordinary invoices are not represented as invalid solely because they lack a MyInvois QR code. Corrections, cancellations and credit/debit notes follow the rules applicable to the document and OnHypp's tax status. Tax exemptions and rates are assessed separately from e-Invoice requirements.
## 3. Delivery and service scope
Activation is normally targeted within 1-3 business days after cleared payment, complete information and required access, subject to registrar/provider checks. This is an estimate, not a guaranteed delivery deadline. OnHypp will communicate material delays. Website delivery dates follow the accepted project scope.
The accepted order specifies the mailbox count, per-mailbox capacity, domain, hosting resources, service term and any upgrades. Additional users or capacity may require a paid upgrade. An unlimited-account plan does not mean unlimited per-mailbox storage or unrestricted server resources. Provider fair-use/resource restrictions must be disclosed where relevant to the order.
Services depend on upstream hosting, registrars, networks and third-party software. OnHypp remains responsible for the work it agrees to perform; upstream failure is not an automatic exclusion of every customer remedy.
## 4. Email and technical support
Standard email service is hosted email using the protocols and features stated in the order, such as IMAP/SMTP and webmail. Microsoft Exchange/Microsoft 365 administration, Teams integration and Exchange-style shared calendars are excluded unless expressly contracted. Delivery to every recipient or compatibility with every application cannot be guaranteed.
Support covers the purchased hosting/mailbox service and agreed server-side configuration. End-user device setup, Outlook or other software licensing, operating-system faults, device repairs and on-site support are excluded unless included in writing. Any agreed setup guidance does not create unlimited ongoing device support.
Requests may be sent to sales@onhypp.com or the contact channel on the invoice. Support is handled on a reasonable best-effort basis, prioritising widespread outages. No 24/7 staffing, fixed response/resolution time, uptime guarantee or automatic service credit is promised unless a separate written SLA states support hours, measurement, exclusions and remedies. A client's 24-hour business operation does not create 24-hour support.
## 5. Website services and complimentary Starter website
A free Starter website is included only when expressly stated in the accepted hosting/domain offer. Its scope is up to 3 pages, 3 revision rounds, responsive layout, contact form, WhatsApp/social links, basic SEO and initial setup/launch. It is not a custom application or e-commerce build. Paid Standard/Premium designs and extras follow their accepted scope.
The client supplies lawful text, branding, images and approvals. The client should claim the benefit and supply the required content within 30 calendar days of activation. If delayed, OnHypp will send a reminder and allow a further 14 days before closing the complimentary allocation; extensions may be agreed in writing. The benefit has no cash redemption value.
Additional pages, revisions, integrations, content creation and ongoing edits/maintenance are charged only where separately agreed. Any support or maintenance expressly included in the order remains included. Basic SEO is not a ranking or sales guarantee. OnHypp will address defects in its agreed delivery under applicable law; a free benefit does not eliminate responsibility for all workmanship.
## 6. Security, personal data and backups
OnHypp uses reasonable security measures within its service scope. No system is immune from attack. The client is responsible for end-user devices, lawful content, access permissions, strong passwords, supported software and promptly reporting suspected compromise. OnHypp remains responsible for its own agreed configuration and applicable legal duties.
Where OnHypp processes personal data for the client, the client determines the lawful purposes and instructions, and OnHypp processes it to deliver the service, subject to legal requirements. Upstream providers may process or store data in other countries; relevant hosting/subprocessor details and safeguards should be confirmed before sensitive data is uploaded.
Security/confidentiality measures, incident cooperation and applicable notification obligations are not waived by these terms. Do not host patient records or other sensitive applications unless their scope, access controls and data-processing arrangements are separately agreed.
The client should maintain independent backups. Provider backups, where available, are not a guarantee of complete recovery. Backup frequency, retention, restore availability and charges must be stated in the service order if offered. OnHypp will not describe backups as included unless verified. Requests for exports/restores are subject to available data and agreed scope.
## 7. Domains, renewals and ownership
Domain registration/renewal is subject to registrar rules and availability. Record the agreed registrant, renewal date and management access; domain ownership should be in the client's name unless expressly agreed otherwise. Domain renewal is distinct from hosting and website work.
OnHypp will use reasonable efforts to provide renewal reminders to the recorded contact. The client must keep contact details current and pay by the stated deadline. If OnHypp accepts a renewal instruction and payment, it must use reasonable care in processing it.
Late renewal may cause suspension, redemption charges or loss of the domain under registrar rules. Restoration is not guaranteed. Renewal price changes are communicated before acceptance; they do not retroactively increase an agreed paid term.
## 8. Acceptable use and suspension
Illegal content, phishing, spam, malware, unlawful infringement and abusive resource use are prohibited. OnHypp may take proportionate action to protect systems or comply with lawful requests. Immediate suspension may be necessary for an active security threat; otherwise provide notice and a reasonable opportunity to remedy where practicable.
For non-payment, give written warning and a stated suspension deadline before action where practicable. Do not silently erase customer data. Data retention/export deadlines and any deletion schedule must be communicated before termination/deletion, subject to security, legal and provider constraints.
## 9. Cancellation, refunds and migration
The client may request cancellation in writing. Third-party domain/renewal fees and completed, agreed setup/design work are generally non-refundable to the extent the cost is committed or work delivered, subject to applicable law and provider recoveries.
Voluntary early cancellation of a functioning annual service does not ordinarily create a pro-rata refund unless the order or law provides otherwise. If OnHypp fails materially to deliver the agreed service and cannot remedy it within a reasonable time after notice, provide an appropriate remedy, which may include a refund for undelivered services. Fraud, billing errors and mandatory rights are not excluded.
Provide reasonable cooperation for domain transfer and available data export after identity/authority checks. State any agreed migration charges and export/retention deadline. Non-refundable domain fees do not transfer ownership to OnHypp.
## 10. Liability and dispute resolution
Each party is responsible for its own acts and agreed duties. To the extent permitted by law, liability for ordinary contractual claims is capped at the fees paid or payable for the affected service during the relevant 12-month service term. This cap does not limit fraud, wilful misconduct, liabilities that cannot lawfully be limited or mandatory statutory remedies.
To the extent permitted by law, indirect or consequential loss and lost profit are excluded. Data loss is not automatically treated as indirect loss; liability depends on the agreed backup/data duties, cause and applicable law.
First notify sales@onhypp.com with the invoice reference and requested resolution. The parties will try to resolve disputes in good faith. Malaysian law applies. Proceedings may be brought before Malaysian courts or a competent statutory body with lawful jurisdiction; these terms do not remove statutory complaint or tribunal rights.
## 11. Changes and records
Keep written records of accepted scope, pricing, service term, terms version and material approvals. Notify material changes before the next renewal and obtain agreement where required. No unilateral retrospective changes to an accepted paid term. If a provision is unenforceable, the remaining terms continue to the extent legally possible.
